The boss of the company which would have managed a failed recycling system said "material facts were kept from us" by the Scottish government. David Harris was chief executive of Circularity Scotland, the body set up to run the deposit return scheme and which went bust when it was put on hold due to a dispute between the Scottish and UK governments. He was giving evidence at the Court of Session as part of a ยฃ166m lawsuit brought by Biffa, a waste firm contracted to process bottles and cans. Mr Harris said he only became aware of potential problems with UK internal market rules following a media inquiry in February 2023.
